Till all and sindry quhais knaulege thir present letteris sal cum Andro Balfour indwellar in Leytht and Jonet Lumle his spous greting in god evirlesting. Wittis your universiteis that albeit maister Johne Bertoun sone to Alexander Bertoun burges of Edinburgh fear of the landis undirwrittin hes with consent of the said Alexander his fader and Elizabeth Diksoun hid modir lifrentaris of the saidis landis sauld and analiit heretabillie be chairter and sesing to us our airis and assignays all and haul thar his twa aikeris of land and ane half with the pertinentis quhilk umquhiil Johne Smytht occupyit liand within the barony of Restalrig and sherefdome of Edinburgh betuix the landis of umquhill Robert Logane of Coitfeild on the east and west partis, the landis of the laird of Restairig on the south part and the lynx on the north partylyk as at main lenght is specifeit and contenit in thair said charter of alienatioun maid and gevin to us thairupoun Nevirtheless we will and grant and alssua lelelie and treulie be the fayth and treutht in our bodyis byndis and obliss us our airis and assignays to the saidis maister Johne Alexander his fader and Elizabetht his modir and to the said Maister Johnis airis and assignys, that quhat tyme or how sone it sal happin that the langar levand of thaimthre the said Maister Johnis airis and assignys upoun ane day betuix the sone rising and ganging to of that ilk in the new kirk of our Lady in Leytht and thair upoun the hie altar of the samin to content and pay to us the langar levand of us twa our airis and assignys the sowme of fifty pundis usuall money of Scotland havand cours of payment for the tyme and als deliveris with the said sowine ane sufficient letter of tak of the saidis twa aikeris and ane half with the pertinentis maid be the said Maister Johne Alexander and Elizabetht the airis and assignys of the said Maister Johne to us the langar levand of us twa our airis assignys and subtenentis ane or maa for the termis and space of fyve yeris fra the day of the redemptioun of the saidis landis to indure and for the maill yeirlie of fifty shillingis usuall money forsaid to be payit yeirly therfor at Whitsonday and Mertinmes in winter be ewen portiones alanarly in competent dew forme with clauss of varandice as efferis, that thai incontinent efter the payment of the said sowme of fifty pundis and deliverance of the said letter of tak sua to tie maid payit and deliverit as said is, we the langar levand of us twa our airis and assignys sail renunce puirlie and simple resigne frehie quitclaine discharge and outgif to the saidis Maister Johne Alexander and Elizabetht the hangar levand of thaim three and to the said Maister Johnis airis and assignys all and haill the saidis twa aikeris of land and ane half with the pertinentis wit charter sesing and all uthir evidentis maid and gevin to us therupoun and with all rycht dame titill of rycht propirtie and possessioun quhilk in the semen we haif hes had or may haif for us our airis and assignys be ony manner of way in tyme to cum, sauffand to us our airis assignys and subtenentis the said lettir of talc for the foirnemmit yeiris and that we the langar levand of us twa our airis nor assingys sail nocht vilfully absent us fra resaving of the said sowme of fifty pundis and letter of tak forsaid we or thai beand lauchfully varnit and requirit herto be the saidis Maister Johne Alexander and Elizabetht the langar levand of thaim thre the said Maister Johne a assignaysi ether personalie or at our duellingplace for the tynie upoun fourty dayis varnyng of befor in presens of ane notar and witnes as efferis And gif we our airis and assignays absentis us fra risseving of the said sowme and – letter of talc forsaid we or thai beand varnit therto as said is, than and in that caiss it salbe lefuhl to the saidis Maister Johne Alexander and Elizabetht the langar levand of thaim three the said Maister Johnis airis and assignays to ha regres and ingres in and to the propirte and possessioun heretabili of the saidis landis salibe as thai had of the samin beforthe alienatioun maid to us thereupoun but ony proces of law or obstakill quhatsumevir, Nevirtheles the forsaid sowme and lettir of tak to the utilite and proffitt of us our airis and assignayis undir sure keping to be put in the handis of ane of the baillies of the toun of Leytht being for the tyme, all fraude and gile avay put In witnes of the quhik thing to thin present letteris subscrivit with our handis our selis ar to hungin tt Leytht the last day of Aprill the yeir or God ane thousand five hundreth and fourty sex.jreiris Befor thir witness Wat Pery James Young Thomas Clerksoun and John Makneill notar publict with utheris divers.
